The Trade Hub User Agreement

Welcome to The Trade Hub, a marketplace platform operated by Horn Tech Pty Ltd ABN 43661793988 trade as Thetradehub  ("Horn Tech Pty Ltd", "we", "us", or "our"), accessible via our website, mobile applications, and sub-domains (collectively referred to as the “Platform”). The Trade Hub connects buyers with third-party sellers ("Sellers") offering a variety of products.

By accessing or using the Platform, you agree to be bound by these terms and conditions ("Agreement"). Please read this Agreement carefully before using our services.

1. Platform and Services Availability

• We reserve the right to modify, discontinue, or restrict access to the Platform or any part of our services without prior notice.

2. Orders and Cancellations

• Orders placed through The Trade Hub are subject to acceptance by us or the Sellers. We or Sellers may cancel orders under certain conditions. Cancellation policies may vary by Seller. Refunds will be issued for canceled orders.

3. Liabilities

• Subject to consumer law rights, The Trade Hub is not liable for indirect losses outside of our own negligence or misconduct. We are not parties to the agreement between you and Sellers, excluding transactions with our subsidiary Duke Living Pty Ltd or other entities where explicitly stated.

4. Fees to Sellers

• The Trade Hub may collect fees from Sellers for products sold through the Platform.

5. Changes to Terms

• We may update these terms at any time. The terms in effect at the time of your order will apply to that order.

About You

• Users must be at least 18 years old, reside in Australia, and have the legal capacity to enter into agreements with The Trade Hub and/or Sellers.

Registration & Guest Checkout

• Users can create an account for additional benefits or use guest checkout. Account details must be kept secure, and accounts are non-transferable.

Our Site, License, and Use Restrictions

• The Platform is provided for personal use. Users must not misuse the Platform or infringe on our or any third party's intellectual property rights.

Our Role in Transactions

• The Trade Hub acts as a marketplace and is not directly involved in transactions between Users and Sellers, except where specified. Our role is limited to facilitating transactions and providing support services.

Products

• Product information is provided by Sellers. We strive for accuracy but cannot guarantee the absence of errors.

Ordering and Delivery

• Orders are subject to this Agreement and applicable Seller terms. Delivery times are estimates and may vary.

Canceling Orders

• Orders may be canceled by us or Sellers under certain conditions. Refunds will be provided for canceled orders.

Everyday Rewards Terms

Coupons

Title and Risk

• Title and risk in products pass to the buyer upon delivery.

• Return policies vary by Seller. Change of mind returns are subject to Seller discretion and terms.

Problems with Products or Disputes with Sellers

• Users have rights under consumer law for products purchased. Disputes should first be addressed with the Seller, with escalation to The Trade Hub if necessary.

Liability

• The Trade Hub's liability is limited as described herein, subject to consumer law rights.

Email & SMS Policy

• Users agree to receive communications from The Trade Hub and Sellers regarding their purchases and offers.

Links to Third Party Websites

• The Platform may contain links to third-party sites, which are not governed by this Agreement.

Use of the Site Outside Australia

• The Platform is intended for use within Australia. Users accessing the Platform from outside Australia do so at their own risk.

Privacy

• Personal information provided to The Trade Hub is protected under our Privacy Policy.

Intellectual Property

• Intellectual property rights in the Platform content are owned by or licensed to The Trade Hub.

Support Services

• The Trade Hub provides support services to assist with User inquiries and disputes with Sellers.

Miscellaneous

• This Agreement is governed by the laws of Victoria, Australia. Changes to the Agreement will be effective upon posting or notification.

By using The Trade Hub, you acknowledge and agree to these terms. This Agreement represents the complete agreement between Users and The Trade Hub regarding the use of the Platform.
